wishes of Papuan people on a referendum in the Land of Papua has been
debated since last week among people in the Land of Papua, the
Government of Indonesia and the United Nations (UN).</div>

Denials and accusations have sprung up in various national media
since the petition was published by the British media, The Guardian. The
Indonesian government accused Benny Wenda, the actor behind the
petition of lying and spreading hoax.</div>

Quoting the statement of the Chairman of Decolonization Special
Committee known as C24, Rafael Ramirez, Permanent Mission of the United
Nations in New York said there was no petition from West Papua received
by C24.</div>

<div style="text-align: justify;">
On the other hand, Benny Wenda said that if the petition was a hoax
as stated by the Indonesian government, why would anyone be jailed for
organizing the signing of the petition? He already suspects Indonesia
will do anything to discredit the petition, himself and other West
Papuan leaders, even the people of West Papua.</div>

However, some Papuans have the view that submitting the petition is
not a substantial matter. The Indonesian government must recognize that
the policy in the Land of Papua has not yet satisfied the Papuan
indigenous (OAP).</div>

<strong>Response from Papua</strong></div>
<div style="text-align: justify;">
Responding to the furor of this petition, Papuan legislator Laurenz
Kadepa said the current mutual claims between the Indonesian government
and Benny Wenda are not the substance of the Papua issue. The most
important thing it should be a lesson for the government so that
policies for Papua should be evaluated from all aspects, especially
human rights.</div>
<div style="text-align: justify;">
“Hoax or true, the petition information is not to be debated. Now the
human rights issue in Papua is on the UN agenda and it will be an
obstacle for the Indonesian government. Because the states that concern
of Papua human rights continue to grow, not just Melanesian countries,”
said Kadepa, Sunday (October 1).</div>

“The Indonesian government should correct itself and improve its policy in Papua,” Kadepa continued.</div>

While the Chairman of West Papua National Committee, Victor Yeimo to
Benar News confirmed that even if without any petition everyone knows
the desire of the people of Papua, which is to hold a referendum as a
media to shape the fate of Papuan people.</div>

Regarding the Chairman of C24’s rebuttal, according to Yeimo, if
Chairman C24 refuses to accept the petition in his capacity as chairman
it is reasonable because the authority of the commission is still in the
17 territorial of non self governance territories. Ramirez has the
right to refuse the formal acceptance.</div>

“What must be understood by the people of Papua is the chairman of
C24 himself in the interview video said that West Papua was listed by
General Assembly. It means he explains the procedural issues that are
need to be encouraged. So, the petition is good as public awareness, but
the main thing for the Papuan people is to strengthen the strength of
domestic struggle, to encourage the liberation process of the people of
Papua, “said Yeimo.</div>

The same is said by Markus Haluk, one of the ULMWP’s work teams. In
fact, on Tuesday 26 September 2017 Benny Wenda, accompanied by Rex
Rumakiek, one of the executives of United Liberation Movement for West
Papua (ULMWP), submitted a petition to the chairman of the UN
Decolonization Commission in New York.</div>

“If there is a response from the Government of Indonesia that says it
is a lie, I think it’s all okay. We pray and work that in time the
truth is upright for the Nation of Papua and Indonesia and the UN,” said
Haluk.</div>

ULMWP continues, focusing and working on the right of
self-determination without being disturbed by the furor that arose from
the petition.</div>

<strong>Benny Wenda and his petition</strong></div>
<div style="text-align: justify;">
Benny Wenda, a Papuan independence leader claimed to have handed the
West Papua People’s Petition to a C-24 representative. After the news of
the submission was released by British media, The Guardian, the
Government of Indonesia immediately denied it and named the petition as a
publicity stunt without any credibility.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
To reporter, Benny Wenda said he submitted the petition to C24
representatives on September 26 at the Office of the United Nations
General Assembly in New York. He was with Rex Rumakiek who submitted the
petition to C-24 representatives. </div>

“More than 70% of the population in Papua wants a referendum in West
Papua. Bishop Desmond Tutu and Noam Chomsky are two of the world’s
leading figures who signed the petition, “Benny Wenda told the contents
of the petition.</div>
<div style="text-align: justify;">
Wenda further said that the people of West Papua who are supported by
the international community very much trust in the petition demand.
West Papuan people demand West Papua to become a non-self-governing
territory with full rights to liberty and freedom.</div>

The signing of this petition does not go smoothly. Recorded petitions distributed online through the <a data-saferedirecturl="https://www.google.com/url?hl=en-GB&q=http://avaaz.org&source=gmail&ust=1507247458896000&usg=AFQjCNExFxjnYMvG_vlUToBGGNnaa76Otw" href="http://avaaz.org/">avaaz.org</a>
site were blocked by the Indonesian government by the end of 2016.
Similarly, petitions were manually executed since April 2017. According
to the ULMWP records, 57 people were arrested for supporting the
petition. Among them are Yanto Awerkion, Vice Chairman of West Papua
National Committee (KNPB) of Mimika and its secretary Sem Ukago on
Tuesday (December 7, 2016).</div>

“Yanto and Sem are threatened with Article 169 of the Criminal Code
for participating in associations aimed at committing a crime, or
participating in other associations prohibited by general rules, are
punishable by imprisonment of up to six years,” added Benny Wenda.</div>

<strong>Indonesian denial</strong></div>
<div style="text-align: justify;">
The petition has made the Permanent Mission of Indonesia to the
United Nations, New York, Triansyah Djani, issued a press release
quoting an interview with Rafael Ramirez.</div>

“As the Chairman of the UN Decolonization Special Committee (C-24), I
and the Committee Secretariat, have never received, formally or
informally, any petition or anyone about Papua as reported in the
Guardian newspaper,” Rafael Ramírez said in a press release.</div>

Ambassador Ramirez further affirmed that he highly respects the
integrity and sovereignty of all members. The mandate of the
Decolonization Committee, he added, is limited to 17 Non-Self-Governing
Territories and Papua is not included in the 17 territories.</div>

Ramirez’s statement is supported by an interview video broadcasted
extensively through a youtube channel by the Permanent Mission of
Indonesia to the UN, New York.</div>

Indonesian foreign ministry spokesman Arrmanatha Nasir, who
participated with the Indonesian delegation at the UN General Assembly
meeting in New York, called the petition an unfounded action.</div>

“It’s a pure publicity action without credibility,” he said, quoted by The Guardian.</div>
<div style="text-align: justify;">
Papua, continued Nasir is an integral part of Indonesia as stipulated
in United Nations General Assembly resolution 2504 (XXIV) 1969.</div>

<strong>Support of British MPs</strong></div>
<div style="text-align: justify;">
The All Party Parliamentary Group (APPG) of England is fully supports
the West Papua people’s petition. APPG release received by Jubi on
Wednesday (September 27) said this petition provides strong evidence
that the people of West Papua want to express their hope for a better
future.</div>

<div style="text-align: justify;">
Therefore, according to Hon. Alex Sobel, APPG member (from the
British labor party) acknowledged that all APPG members support West
Papuan people in calling for their inalienable right to
self-determination democratically, so that they can freely decide their
own future peacefully.</div>

“We will also step up this significant development with the British Government,” Alex Sobel said.</div>

The development of the human rights
situation in West Papua during 2013 and 2014 shows a deterioration
compared to the period covered by the ICP’s previous report. West Papua
on the Guinea island bordering Asia and the Pacific and comprising the
two east Indonesian provinces of Papua and Papua Barat continues to be
one of the regions of Asia most seriously affected by human rights
violations and an unresolved long standing political conflict. The
living conditions of the indigenous Papuan peoples are in stark contrast
to those of the trans-migrants from other parts of Indonesia.</div>

<span style="font-size: 10pt;">After monitoring 20 months of the human rights
situation in Papua and West Papua provinces under President
Joko Widodo’s administration, the Asian Human Rights
Commission (AHRC) is dismayed at the utter lack of progress
in the protection and realization of people’s rights.
Since President Widodo’s inauguration on 20 October
2014, there were considerable expectations for improvement
in Indonesia’s human rights situation, particularly in
Papua and West Papua. President Widodo was believed to have
a strong commitment to addressing the various human rights
violations in Papua, providing remedies for victims and
families, and evaluating the presence of security forces in
the province. Over a year of his presidency however, has
neither resolved any of the past human rights violations,
nor seen any adequate remedy and guarantee for non
recurrence given to the victims.</span></div>

indigenous Papuans. Similarly, government development of
public infrastructure has an economic and business
orientation rather than benefits for the local community.
The government’s attempts to boost international
investment to Papua and West Papua will likely see an
increase in migration to the provinces from elsewhere in
Indonesia, further fuelling local discontent.</span></div>

<span style="font-size: 10pt;">Furthermore, criminal justice institutions in the
provinces do not function to address human rights problems.
The police are frequently involved in various human rights
violations in the two provinces, and the accountability
mechanism has failed to address this problem. The Paniai
case of 8 December 2014, where four indigenous Papuan
children were shot to death, two adults seriously injured,
and 17 others injured (<a data-saferedirecturl="https://www.google.com/url?hl=id&q=http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-089-2015&source=gmail&ust=1466251046513000&usg=AFQjCNHZ6jHoFpvrsrLW16fLRaKEjYqZoQ" href="http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-089-2015" target="_blank"><b>AHRC-UAC-089-2015</b></a><b>)</b>
is an indicative example of the brutality faced by Papuans,
as well as the lack of any effective investigation or
remedies. Other cases that have also not been investigated
and prosecuted under President Widodo’s administration
include the case of a member of the Air Force heavily
maltreating 22-year-old Amsal Marandof (<a data-saferedirecturl="https://www.google.com/url?hl=id&q=http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-143-2015&source=gmail&ust=1466251046513000&usg=AFQjCNHSmISh3yKi6OlTbOR-w2ur_nnquw" href="http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-143-2015" target="_blank"><b>AHRC-UAC-143-2015</b></a>),
the case of arbitrary arrest and torture of three indigenous
Papuans on 27 August 2015 (<a data-saferedirecturl="https://www.google.com/url?hl=id&q=http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-003-2016&source=gmail&ust=1466251046514000&usg=AFQjCNF1ceVvwQ2RFs93ZvjDwLIykwL3Ng" href="http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-003-2016" target="_blank"><b>AHRC-UAC-003-2016</b></a>),
and the case of the shooting and brutal attack on 10
indigenous Papuan youth conducted by police officers of Tigi

<span style="font-size: 10pt;">The AHRC has also observed the Indonesian
government’s lack of willingness to deal with past
human rights abuses in Papua and West Papua provinces. The
investigation report of the National Commission on Human
Rights (Komnas HAM) on the gross violations in Wasior Wamena
Papua (2001 and 2003), for instance, has been sitting with
the Attorney General for the past eight years, without any
action taken by that office. In the allegations of genocide
in the Central High Lands of Papua from 1977-1978 as well,
although the AHRC submitted a report to Komnas HAM, as of
yet there is no progress in the investigation. While Komnas
HAM initiated establishing a team in November 2015 to audit
human rights violations beginning from the integration of
Papua to the Republic of Indonesia until the case of
Tolikara (<a data-saferedirecturl="https://www.google.com/url?hl=id&q=http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-106-2015&source=gmail&ust=1466251046514000&usg=AFQjCNEr_Rvvjdb6F7M1ePxbUvEg2HcjiQ" href="http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-106-2015" target="_blank"><b>AHRC-UAC-106-2015</b></a><b>,

<span style="font-size: 10pt;">Recently, a government initiative under the
Coordinator Minister of Politic and Security
(Menkopolhukam), Mr. Luhut Binsar Panjaitan, was announced,
to establish a special team dealing with human rights
violations in Papua and West Papua provinces. Local human
rights groups however, have largely rejected the initiative,
saying that representative indigenous Papuans in the team
are not genuinely representing indigenous Papuans on the
ground. In fact, the initiative is typical of the government
process to suddenly establish a team without proper
consultation and discussion with Papuans on the ground. The
government tends to simplify the problems in Papua, and its
economic and infrastructure perspective on Papua does not
seriously take into consideration the history of human
rights violations occurring from the time of integration to
the present.</span></div>

<span style="font-size: 10pt;">The AHRC therefore calls for President Joko Widodo
and his administration to take serious and comprehensive
steps to deal with the various human rights problems facing
Papua and West Papua provinces. The government should stop
seeking political benefits in dealing with the provinces,
and focus on improving the situation of the local
communities. In particular, the government must guarantee
protection of local indigenous Papuans, local human rights
defenders and journalists, and consistently open Papua and
West Papua to international monitors to ensure the progress

The Asian Legal Resource Centre (ALRC) and the Independent Journalist Alliance of Indonesia (AJI Indonesia) wish to draw the UN Human Rights Council’s attention to the rampant human rights violations against the right to freedom of opinion and expression in Indonesia. Under current President Joko Widodo’s administration, the security forces and vigilante groups are the actors to committing these violations most frequently.</span></div>

In particular, the circumstances have worsened with the government’s application of Law No. 11 of 2008 on Information and Electronic Transaction (ITE), and Law No. 44 of 2008 on Pornography, which severely restrict freedom of opinion and expression. Under the law on pornography, journalists and others can be sentenced for more than 10 years for publications that contain pornography. In the last one year, the Press Legal Aid (LBH Press) notes that 134 journalists were charged with the ITE Law, the revision process of which has yet to show progress.</span></div>

Furthermore, the government remains reluctant to review other controversial laws that can restrict rights, such as the Blasphemy Law, the Indonesian Penal Code (KUHP)’s provisions on criminal defamation, the Law on Intelligence Agency, the Bill on National Security, the Law on Conflict and Resolution (UU PKS), and the National Chief Police Regulations on Hate Speech (Perkap), which regulates hate speech in public, including on social media.</span></div>

In December 2015, for instance, the police brutally attacked Mr. Zuhdy Febryanto, a journalist of <strong><a href="http://riauonline.co.id/" style="color: #7f9258; text-decoration: none;">RiauOnline.co.id</a></strong>, while he was doing his job, even though he had shown them his press identity card. On 13 November 2014, the police brutally attacked seven journalists in Makassar, South Sulawesi Province, who were documenting and reporting on the forced dispersal of university protesters. One of the journalists had to be taken to the hospital.</span></div>

<span style="font-size: 10pt;">5. Moreover, the AJI Indonesia notes that the police, as a law enforcement agency, on one hand becomes a perpetrator of violence against journalists, while on the other, fails to investigate cases of mysterious killings against journalists. There are eight cases of murder against journalists constituting “dark cases”: First, the murder of Mr. Fuad Muhammad Syafruddin (Udin), a journalist of Bernasnewspaper in 1996; Second, the murder of Mr. Naimullah, a journalist of Sinar Pagi newspaper in 1997; Third, Mr. Agus Mulyawan, a journalist of Asia Press, killed in 1999; Fourth, the murder of Mr. Muhammad Jamaludin, a journalist of TVRI in 2003; Fifth, the murder of Mr. Ersa Siregar in 2003; Sixth, the murder of Mr. Herliyanto, a journalist of Delta Pos Sidoarjo magazine in 2006; Seventh, the 2010 murder of Mr. Adriansyah Matra Wibisono, a journalist working in local TV in Merauke, Papua Province; and Eighth, Mr. Alfred Mirulewan, a journalist of Pelangitabloid in 2010. The investigations of these cases remain unclear until present.</span></div>

<span style="font-size: 10pt;">6. In the past year, the pattern of threats against freedom of press has changed. Earlier, media or journalists who published the news were subjected to prosecution. Recently however, resource persons who speak in the media are targeted with criminalization and prosecution. For instance, the criminalization against activists of the Indonesian Corruption Watch (ICW), Mr. Emerson Yuntho and Mr. Adnan Topan Husodo, both of whom were summoned by the police after criticising the selection process of the new Commissioner of the Corruption Eradication Commission (KPK).</span></div>

<span style="font-size: 10pt;">7. A similar case also occurred against Mr. Erwin Natosmal Oemar, an anti-corruption activist at the Indonesian Legal Roundtable (ILR). The ALRC’s sister organization, the Asian Human Rights Commission (AHRC), documented and reported that Erwin was summoned by the Police after he spoke on a TV talk show (<strong><a href="http://www.humanrights.asia/news/urgent-appeals/AHRC-UAC-008-2016" style="color: #7f9258; text-decoration: none;">AHRC-UAC-008-2016</a></strong>) on 25 August 2015 about the “Impact of Sarpin case: Supreme Court (MA) Vs Judicial Commission (KY).” Other resource persons present on the show included Professor Mahfud M.D., former Chairperson of the Constitutional Court and Police Inspector General Anton Charliyan.</span></div>

<span style="font-size: 10pt;">8. Police criminalization against activists have been reported to the Press Council (Dewan Pers), and the council has officially stated that such cases constitute a journalistic endeavor, however, the police insist on proceeding with their investigation until the prosecution stage. According to the law on Press as well as the statement of the Press Council, the media that publishes their statements must protect resources persons who make statements in the media.</span></div>
<div style="background-color: white; font-family: Arial, Helvetica, sans-serif; font-size: 12px; line-height: 18px; margin-bottom: 0.75em; padding: 0px; text-align: justify;">
<span style="font-size: 10pt;">9. Meanwhile, the Commission for the Disappeared and Victims of Violence (KontraS), a prominent national human rights organization, documented in its annual report that in 2015 alone, 238 cases of violations against the right to freedom of expression occurred. The police are the most frequent violators, in 85 cases. The violations consist of forced dissolution of peaceful public events and protests, illegal arrest, and violence against civilians. Beside the police, other State officials committed violations against such rights in 49 cases, the Military officers in 17 cases, and members of vigilante groups in 31 cases.</span></div>
<div style="background-color: white; font-family: Arial, Helvetica, sans-serif; font-size: 12px; line-height: 18px; margin-bottom: 0.75em; padding: 0px; text-align: justify;">
<span style="font-size: 10pt;">10. Most recently, the AHRC, along with its local partners has been monitoring sweeping operations, involving the seizure of various books allegedly containing ideas of Communism and Marxism. The Police, the Army, and other State departments, as well as vigilante groups, have conducted these sweeping operations. Anyone wearing clothing with the hammer and sickle symbol has been arrested on the principle that wearing such clothing constitutes spreading communist ideology. Although the security forces finally released such persons, the mass arrests and book sweeping have caused considerable public fear. These operations have been grave violations of the Indonesian Constitution, which acknowledges and guarantees the right to freedom of expression and opinion without any discrimination.</span></div>
<div style="background-color: white; font-family: Arial, Helvetica, sans-serif; font-size: 12px; line-height: 18px; margin-bottom: 0.75em; padding: 0px; text-align: justify;">
<span style="font-size: 10pt;">11. Considering the lack of protection of the right to freedom of opinion and expression, and the repeated persecution against journalists and activists in Indonesia, the ALRC and AJI Indonesia respectfully request the Human Rights Council to:</span></div>

<span style="font-size: 10pt;">b. Urge the government to seriously protect and guarantee such rights without any discrimination;</span></div>

The Africa Caribbean Pacific (ACP) Summit is currently underway in
Port Moresby, Papua New Guinea and is bringing together heads of state
and other government representatives from around Africa, the Caribbean
and the Pacific. We West Papuans are making our plea to the ACP as a cry
for help because we are being brutally suppressed and silenced under
Indonesian military occupation and colonialism. Across much of Africa,
the Caribbean and the Pacific; colonialism has ended but in West Papua
we continue to endure the horrors of colonialism and genocide with over
half a million West Papuan people estimated to have been killed ever
since West Papua was first occupied by Indonesia in 1963, and later
illegally annexed after the fraudulent <em><strong>Act of NO Choice</strong></em>.</div>

to please support us in solidarity with our ongoing struggle against
this brutal colonialism, racism and genocide.</div>

This week there were rallies held across West Papua as well as in
several Indonesian cities as the people of West Papua took to the
streets in our thousands to peacefully call for the ACP to support our
fundamental right to self-determination as the Melanesian Spearhead
Group (MSG) does. Demonstrations were held in many cities including:
Port Numbay/Jayapura, Biak, Fakfak, Gorontalo, Jakarta, Manokwari,
Nabire, Sorong, Timika, Wamena and Yahukimo.</div>

increasing international support for the people of West Papua and in an
attempt to hide the real situation in West Papua, the Indonesian police
arrested an estimated 597 people simply for joining these peaceful
demonstrations.</div>

There are unconfirmed reports that 469 people were arrested in Port Numbay/Jayapura, 112 people arrested in Wamena, 7 peop<span class="text_exposed_show">le arrested in Manado, 6 people arrested in Gorontalo and 3 people arrested in Yahukimo.</span></div>

Those who were arrested in Manado as well as 70 of those arrested in
Wamena are still believed to be behind bars and are still at risk of
being tortured like so many other West Papuan political prisoners.<br />

Therefore on behalf of my people I appeal to all human rights groups,
the Africa Caribbean Pacific Group of States and the world to please
join us in calling for their immediate release.</div>

<b>Jayapura, </b>– The police’s decision to often not issue a
permit for peaceful demonstrations in Papua and arrest protesters is
evidence that the Government are biased against Papuan people, said the
director of Jakarta Legal Aid Institute, Alghiffari Aqsa SH.<br />
<br />
When asked by Jubi on Monday (30/5/2016) to response the legal status
of series of peace demonstration on self-determination and support for
ULMWP in Papua, he asserted as long as these aspirations were conducted
peacefully, the Police and Indonesian Government must respect it.<br />
<br />
He explained the Police’s refusal to issue STTP (letter of permit)
was not common in other regions (in Indonesia) and was a discriminatory
act.<br />
<br />
According to him, it violated Article 13 Paragraph (1) of Law No. 9
1998 about the Freedom of Expression in the Public. It is also against
the Indonesian Constitution of Article 28 E Paragraph (2) and (3) which
states that everyone has the right to gather, express aspirations and
opinions.<br />
<br />
Further, in Human Rights Law Article 25 Paragraph 19 of the Law No.
12 Year 20015 that ratifying the International Covenant of Civil and
Political Rights is also protect the right of freedom expression and
gathering. He lamented that what was applied in other places just not
worked in Papua. According to him, it could be an indication of denial
over Papuans as the Indonesian citizens.<br />

On Friday (27/5/2016), the Central West Papua National Committee
(KNPB) accepted a letter from the Police state it would not issued the
permit regarding to a notice of peace rally on 31 May. In the letter,
the Police asked KNPB about the compliance of statute and structure of
organization as requirement for demonstration.<br />
<br />
Aqsa said this request is overreacted to ban the freedom of
expression in Papua. At other regions, the Police never asked for it.
“It’s only happened in Papua,” he said. He further explained that
according to Article 17 of Indonesian Police Regulation No. 7 Year 2012
states the Police oblige to file the identity and statute of
organization but it is not a requirement to obtain the permit.<br />
<blockquote class="tr_bq">
“It is an
obligation for the Police to make documentation, but it is not the
obligation of protesters. Furthermore the Article 17 said the statute of
organization need to be file if “available”,” he said.</blockquote>
He added the Police oblige to issue the permit because according to
the Law the demonstration requires a notice not a permit. Even in
Paragraph 14 of Police Regulation, it is said the Police still need to
issue the permit even for the action that potentially disturbed the
safety and order with a note said the action was not suggested.<br />

In the letter signed by Director of Intelligent and Security of Papua
Police Alfred S.IK, it said that KNOB and ULMWP are illegal and against
the Republic of Indonesia. In fact both ULMWP and Indonesia are the
members of the Melanesian Spearhead Group (MSG) that means though they
have a different status, but their existence is equally admitted in the
official forum of the Southern Pacific.<br />

In response this, Aqsa said the action taken by KNPB to give
notification to the Police about their planning should be respected
because the problem is not about the protesters. What is happening now
is the protesters have followed the procedure in accordance to the Law
No 9 Year 1998 but they were banned by the Police.<br />

“The Police could say the rally was illegal, but it is occurred
because of the intention of the Police,” he said. “In my opinion, the
demonstration remains legal because the Constitution and Law 9/1999 is
ultimate than the procedural obstacle by the Police,” he said. He also
added that accordance to the Article 6 No 9/1998 the Police oblige to
maintain the integrity and unity of the nation in expressing their
aspiration, but it could not become a reference rejecting to issue the
permit. “Expressing the aspiration was not happened yet, how come it
could be charged by Law?” he said.</blockquote>
Closing his phone conversation, Alghiffari Aqsa said the Jakarta
Legal Aid Institute as part of Papua Itu Kita (Papua is Us movement)
give supports and respect towards the peace demonstration held by Papuan
people. He expected it could be run peacefully and protesters to not
being provoked by the Police and documenting their actions or arrest
conducted by the Police and invite media to cover it so that the public
could recognize about the arbitrariness if it was occurred.<br />

Meanwhile, from this morning until noon, the Police have arrest
dozens of KNPB activists when distributing the pamphlets about peace
demonstration on 31 May. The Police arrested 25 activists in Sentani at
around 09:00 in the morning and 26 activists in Jayapura at around

week meeting supporters and a handful of politicians. Benny Wenda had an
almost action-movie style escape from an Indonesian jail and he now

<b>Jayapura,</b> – The detention of more than 1,500 Papuan
independence supporters on May 2 for “lacking a permit to hold a rally”
speaks volumes of the government’s stubbornly problematic approach to
dealing with dissent in the restive territory of Papua. This approach
has for decades provided impunity for security forces, despite their
abuses against Papuans and turned dozens of those exercising their
universal rights to freedom of expression and association into political
prisoners.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
President Joko “Jokowi” Widodo has promised Papuans a change,
beginning with “an open dialogue for a better Papua”. But aside from the
release of a few political prisoners, there has been barely any signs
of meaningful change on the ground in Papua.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Jokowi’s December 2014 pledge to thoroughly investigate and punish
security forces implicated in the death of five peaceful protesters in
the Papuan town of Enarotali that month has remained unfulfilled. And
the Indonesian bureaucracy continues to obstruct international media
from freely reporting in Papua despite the President’s May 2015
declaration to lift the decades-old restrictions.</div>

Last month the government announced a new approach to Papua’s long
history of serious rights abuses and lack of accountability: It was
going to try to resolve them.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
On April 20 chief security minister Luhut Pandjaitan opened a
one-week meeting in Jakarta, which was attended by more than 20 human
rights activists and ethnic Papuan officials from Papua and West Papua,
along with officials from the National Police, the Attorney General’s
Office ( AGO ) and various ministries.</div>
<div style="text-align: justify;">
The meeting followed increasing international scrutiny of Indonesia’s
human rights record in Papua, including a September 2015 proposal by
the Pacific Islands Forum, a political grouping of 16 Pacific nation
states, for a possible human rights “fact finding mission” in Papua.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
The meeting aimed to develop a roadmap to investigation and
resolution of a number of the region’s most serious human rights abuses.
The initiative was a follow-up to Jokowi’s commitment in December 2014
to seek an end to human rights violations in Papua.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
The government has compiled a 17-page report detailing 11
high-priority human rights cases in Papua that it aims to solve. They
include the Biak massacre in July 1998, when security forces opened fire
on participants of a peaceful flag-raising ceremony on the island, the
military crackdown on Papuans in Wasior in 2001 and Wamena in 2003 that
left dozens killed and thousands displaced and the forced disbandment of
the Papuan People’s Congress in October 2011 that left three people
dead and hundreds injured.</div>

<div style="text-align: justify;">
The government has also prioritized individual cases such as the
disappearance of Aristoteles Masoka, the driver of murdered Papuan
leader Theys Eluay in November 2001. Although Eluay’s body was found
inside his car, and seven Army Special Forces soldiers were convicted in
2003 for the murder, Masoka has never turned up.</div>

<div style="text-align: justify;">
The list is an encouraging sign that the government recognizes the
role of the security forces in human rights abuses in Papua and the need
for accountability. However, mass killings that took place between the
1960s and 1970s, including a military operation in 1977-1978 against
Free Papua Movement ( OPM ) insurgents that allegedly involved
indiscriminate aerial bombings and strafing, have been deliberately
omitted.</div>

Papuan activists have also called for investigations into the killing
of anthropologist-cum-musician Arnold Ap in April 1984 and rights
abuses linked to the Indonesian security forces in the lead-up to the
July 1969 UN-sponsored referendum that resulted in a much-contested
unanimous vote for continued integration with Indonesia.</div>

<div style="text-align: justify;">
The government’s plan to resolve these cases involves deploying
agencies including the National Police, the AGO, the National Commission
on Human Rights ( Komnas HAM ) and the military police to investigate.
The plan specifies the need for compensation for survivors and victims’
families for incidents in which the evidence clearly indicates the
culpability of government officials and security forces.</div>

<div style="text-align: justify;">
Insp. Gen. Paulus Waterpauw, the Papua Police chief, has promised to
prosecute individuals implicated in those abuses. The government has yet
to publicly disclose a timeline for these investigations.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Papua’s troubled history and ongoing serious human rights abuses
demand a meaningful government response to both address the crimes of
the past and to enact measures to prevent future abuses. The ongoing
low-level conflict with the small and disorganized OPM obligates the
government to ensure security for the population.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Security forces repeatedly fail to distinguish between violent acts
and peaceful expression of political views. The government has denounced
flag-raisings and other peaceful expressions of pro-independence
sentiment in Papua as treasonous. Heavy-handed responses to peaceful
activities have resulted in numerous human rights violations.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
In the past eight years, Human Rights Watch has documented dozens of
cases in which police, military, intelligence officers, and prison
guards have used unnecessary or excessive force when dealing with
Papuans exercising their rights to peaceful assembly and association.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
The government also frequently arrests and prosecutes Papuan
protesters for peacefully advocating independence or other political
change. More than 35 Papuan activists are in prison on treason charges.</div>
<div style="text-align: justify;">
Human Rights Watch takes no position on Papuan claims to
self-determination, but opposes imprisonment of people who peacefully
express support for self-determination.</div>

Papuans are likely to be skeptical of Luhut’s plan to resolve past human
rights abuses unless the positive rhetoric is matched by meaningful
investigations and prosecutions for those crimes. (*)</div>
